Kapjon letöltendő börtönbüntetést a jeladós farkast kilövő vadász!

Egy ország háborodott föl a hír hallatán: lelőtték a jeladóval felszerelt farkast, amelyik néhány hónap alatt bebarangolta fél Európát, majd hazánk területére lépett, és Hidasnémeti környékén eltűnt. A hírek szerint autóval vitték a tetemet egy darabig, majd bedobták a Hernádba. A tettes kiléte már valószínűleg ismert.
„A szürke farkas (Canis lupus) Magyarországon őshonos nagyragadozó, fokozottan védett és kiemelt közösségi jelentőségű faj. A farkas egyedeinek engedély nélküli elejtése – beleértve a lelövést vagy más módon történő elpusztítást –, károsítása, zavarása bűncselekmény, amely három évig terjedő szabadságvesztéssel büntetendő” - írja az Agrárminisztérium.
Ne legyünk következmények nélküli ország. Az az ember, aki egy nemzetközi figyelem által követett, minden országban fokozottan védett, többezer kilométert bejárt nagyszerű állatot tudatosan elpusztít, ne úszhassa meg büntetlenül. Érezze a tettének a súlyát. És a büntetése legyen intő példa mindenki másnak is, aki védett és fokozottan védett állatokat gyilkol.
Ezért azt kérjük minden, az eljárásban résztvevő és majd ítéletet hozó hatóságtól és bíróságtól, hogy a tettes kapja meg a kiszabható maximális büntetést. És az ne csak felfüggesztett, de ténylegesen letöltendő börtönbüntetés legyen. Egy ilyen ítélet, túl azon, hogy a tettes megbűnhődik a tettéért, intő jel lehet más, hasonló szándékú emberek számára is, és legalább minimálisan javíthat hazánk reputációján, amellyel az ország kifejezheti, hogy hangsúlyosan nem ért egyet ezzel a barbár tettel.

FRISSÍTÉS:
Mivel érkezett jónéhány kritika is a petíció szövegére (részben jogosan), szeretnék leszögezni néhány dolgot.
Az aláírásgyűjtésnek semmiképpen nem célja bármiféle "lincshangulat" gerjesztése. Célja elsősorban nem az ember, hanem a tett elleni tiltakozás. Az aláírásokhoz fűzött kommentek többségéből az érződik, hogy ez átjött, az emberek a farkas elvesztése fölötti fájdalmuknak (és nem kevesen a szégyenérzetnek) adnak hangot, és elsősorban a további hasonló eseteket szeretnék megelőzni.
Ugyanakkor a cselekedet nincs magában, annak mégiscsak van egy elkövetője. Ha valamilyen reakciót szeretnénk adni a cselekedetre, azt az elkövetőjén keresztül tudjuk megtenni.
Azért választottam ezt a kissé erős (bár sokak szerint még így is enyhe) követelést, mert
1. ez nem az első eset, hanem a nagyon sokadik, hogy törvény által védett vagy fokozottan védett állatot tudatosan pusztítanak el, mindegy is, hogy mi okból, de nem közvetlen életveszély miatt.
2. Ezeknek a cselekedetnek soha nem volt még olyan szintű következménye, hogy bárkit elriasszon attól, hogy újra megtegye. Természetvédők, állatvédők és akik követik az ilyen ügyeket, pontosan tudják, hogy pénzbüntetés és/vagy felfüggesztettnél többet még soha nem szabtak ki itthon védett állat elpusztítása vagy állatkínzás miatt. Amiknek viszont semmilyen visszatartó ereje nincsen.
3. Nagyon sokan érezzük úgy, hogy az állatok jogainak semmibe vétele és a természet törvénybe szabott védelmének megsértése új szintre emelkedett a nemzetközi figyelemmel is kísért farkas lelövésével. Ezért sokunkban fogalmazódott meg a vágy arra, hogy az igazságszolgáltatás is lépjen szintet akkor, amikor ennek az ügynek a vétkeséről dönt. A következő szint pedig - tetszik-nem tetszik - az, ami a petíció címében meg van fogalmazva.
4. Hiszek, hiszünk a jogállamban és az igazságszolgáltatás arányos és független voltában, és tisztelem, tiszteljük a bírói függetlenséget. Jogállamban nem petíció alapján hoznak ítéletet (írják sokan), hanem jogszabályok és mérlegelés alapján. Ez igaz. Ugyanakkor az igazságszolgáltatásnak is kell éreznie, hogy itt bármilyen döntés születik, az precedensértékű lesz. Ha enyhe ítélet, akkor azért (itt bármit lehet). Ha szigorú, akkor pedig azért (hát bármit azért mégsem). A mérlegelés terét pedig talán éppen az ügy társadalmi súlya jelöli ki. Az volt a célom, hogy akik úgy gondolják, hogy elég volt, húzzunk végre egy határt az öncélú természetpusztításban, azok ezt kifejezhessék. Hogy ezt végre ki lehessen fejezni valahogyan. És mindent el fogok követni, hogy ez a rengeteg vélemény, harag és fájdalom, ami itt megfogalmazódott, eljusson azokhoz, akik végül az ítéletet hozzák majd ebben az ügyben.

On 12/04/2023, the whole of Hungary was shocked by the news that the young male wolf M237 that started from Switzerland and had traveled thousands of kilometers was shot by an unknown hunter, just a few kilometers from the country's northern border.
According to the news, the dead body of the wolf was taken by car for a while and then thrown into river Hernád. The identity of the culprit is already known. The indignation became international, as the signal wolf's record-long journey was closely followed
throughout Europe and even on other continents. The Hungarian authorities are actively investigating the culprit.
As the Hungarian Ministry of Agriculture also published: "The gray wolf (Canis lupus) is a large carnivore native to Hungary and is strictly protected and a species of community interest. Killing, damaging or disturbing wolf individuals without official permission -
including shooting or destroying them in any other way - is a crime punishable by up to three years in prison." Europe-wide the wolf is considered as a strictly protected species under the Bern Convention and 5 other international agreements
(https://eunis.eea.europa.eu/species/Canis%20lupus ) Strict protection rules are set out in the EU Habitats Directive which national authorities should follow in order to stop the capture and killing of endangered species in the wild.
Despite all these protections, unfortunately, this is not the first, first, but the umpteenth case that a legally protected or highly protected animal is deliberately destroyed, no matter what the reason, but not due to a direct threat to life. The phenomenon occurs not only in Hungary, but also in many other European countries. These kind of actions have never had such a serious consequence that would deter anyone from commiting it again.
Conservationists, animal rights activists and those who follow such cases know exactly that more than a fine and/or a suspended sentence has never been imposed for the destruction of a protected animal or animal cruelty in Hungary. Which, on the other hand, have no restraining power.
Many of us feel that the disregard for the rights of animals and the violation of the statutory protection of nature have now risen to a new level with the shooting of the wolf M237 that was also in the center of international attention. This is why many of us feel the rise of desire that the justice system rise to a new level as well and step up when it decides on the culprit of this case. And the next level of punishment should not only be a suspended prison sentence, but one that must actually be served.
We want that a person who knowingly destroys a great animal that has been in the center of international attention, is highly protected in every country, and has traveled thousands of kilometers, should not be allowed to go unpunished! He or she needs to feel the weight of his or her actions. Therefore, we ask all the participating and sentencing authorities and the court to punish the perpetrator (and in general, the perpetrators of similar acts) with the maximum penalty that can be imposed. Such a verdict, in addition to the fact that the perpetrator gets punished for his or her deeds, can serve as a warning sign to others with similar intentions.

Peine maximale possible pour le chasseur qui a abattu le loup à collier M237
Le 12 avril 2023, toute la Hongrie a été choquée par la nouvelle d'un jeune loup mâle, qui avait parcouru des milliers de kilomètres depuis la Suisse, abattu par un chasseur inconnu à quelques kilomètres seulement de la frontière orientale du pays. Selon certaines informations, la carcasse a été transportée en voiture pendant un certain temps avant d'être jetée dans la rivière Hernád. L'identité de l'auteur est probablement déjà connue. Le tollé est devenu international, des personnes de toute l'Europe et même d'autres continents ayant suivi le voyage record du loup phare. Les autorités hongroises mènent une enquête approfondie sur le coupable.
Selon le ministère hongrois de l'agriculture, "le loup gris (Canis lupus) est un grand carnivore natif aussi de Hongrie, une espèce hautement protégée et une espèce d'intérêt communautaire particulier. L'abattage non autorisé, y compris le tir ou toute autre forme d'élimination, d'endommagement ou de perturbation des loups est une infraction pénale passible d'une peine d'emprisonnement pouvant aller jusqu'à trois ans." Le loup est une espèce hautement protégée dans toute l'Europe en vertu de la convention de Berne et de cinq autres conventions (https://eunis.eea.europa.eu/species/Canis%20lupus ). La directive "Habitats" de l'UE fixe des règles de conservation strictes que les autorités nationales doivent respecter pour mettre fin à la capture et à l'abattage d'espèces menacées à l'état sauvage.
Malgré toutes ces protections, ce n'est malheureusement pas la première fois qu'un animal protégé ou hautement protégé par la loi est délibérément tué pour des raisons autres qu'une menace imminente pour sa vie. Ce phénomène est courant en Hongrie et aussi dans de nombreux autres pays d'Europe. Ces actes ont rarement, voire jamais, eu des conséquences d'une ampleur telle qu'ils auraient dissuadé quiconque de recommencer. Les défenseurs de l'environnement, les militants des droits des animaux et ceux qui suivent ces affaires savent que, dans ce pays, l'abbatage d'un animal protégé ou la cruauté envers les animaux n'ont jamais donné lieu qu'à une amende et/ou à une peine de prison avec sursis. Ces amendes et ces peines n'ont aucun effet dissuasif.
Nous sommes nombreux à penser que le mépris des droits des animaux et la violation de la protection de la nature par la loi ont atteint un nouveau niveau avec l'abattage du loup, qui a fait l'objet d'une attention internationale. C'est pourquoi beaucoup d'entre nous émettent le souhait que la justice franchisse un pas concernant le coupable dans cette affaire. Le niveau suivant est celui de la peine d'emprisonnement à purger.
Nous voudrions qu'un homme qui tue délibérément un animal magnifique, suivi par l'attention internationale, hautement protégé dans tous les pays, qui a parcouru des milliers de kilomètres, ne reste pas impuni. Qu'il ressente le poids de ses actes. Nous demandons donc à toutes les autorités et à tous les tribunaux impliqués dans la procédure, ainsi qu'à ceux qui prononceront la sentence, de veiller à ce que l'auteur (et, en général, les auteurs d'actes similaires) reçoive la peine maximale encourue. Une telle peine, en plus de punir l'auteur pour ses actes, pourrait constituer un avertissement pour d'autres personnes ayant des intentions similaires.
RIP Wolf M237. Nous ne t'oublierons jamais.
